2. Purpose
In compliance with the Electronic Commerce (EC Directive) Regulations 2002, Electronic Commerce (Amendment etc) (EU Exit) Regulations 2019, the Data Protection Act 2018 and UK GDPR, this notice sets out the terms governing the use of the Tuition4U GCSE Mathematics revision platform (the "Platform").
These Terms of Service, together with our Privacy Policy and Cookie Policy, govern your use of the Platform and form a legally binding agreement between you and Tuition4U.
3. Conditions of Use
Access to the Platform gives you the status of User and implies knowledge and unconditional acceptance of all clauses and conditions included in these Terms of Service, Privacy Policy and Cookie Policy. These pages aim to inform users of their rights, responsibilities, and other circumstances that govern use of the Platform.
If you are not satisfied with these clauses and conditions, please refrain from using this Platform.
Access to the public areas of the Platform does not, in itself, imply a business relationship with Tuition4U. However, registration for an account and/or subscription to our services does create a contractual relationship governed by these Terms.
4. User Eligibility and Consideration
A User is defined as any person who accesses, browses and uses the Platform, its services and/or the content housed therein. Different categories of users have different eligibility requirements:
4.1 Students
- Users under 13 must have parental or guardian consent to use the Platform
- Users under 18 are encouraged to provide a guardian email address during registration
- Student accounts are typically created by teachers or administrators
4.2 Teachers and Administrators
- Must be at least 18 years old
- Must provide accurate professional information during registration
- Are responsible for appropriate use of the Platform within their educational context
4.3 Parents and Guardians
- Access to the Platform by minors will be understood to be expressly authorised by their parents, guardians or legal representatives
- Parents/guardians are deemed responsible for the acts that minors carry out as Users of the Platform
All users must provide accurate information during registration and keep such information up to date.
5. Account Registration and Authentication
To access certain features of the Platform, you must have an account:
- You must provide a valid email address for authentication
- We use passwordless authentication via magic links and one-time codes
- You are responsible for maintaining access to your registered email address
- You must not share your login links or codes with others
- You must notify us immediately of any unauthorised access to your account
- Login links expire after 10 minutes for security reasons
We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.
6. Subscription Services and Fees
Tuition4U offers subscription-based access to premium features and content:
6.1 Subscription Plans
- Different subscription tiers may be available with varying features and pricing
- Subscription details, pricing and features will be clearly displayed before purchase
- Some features may be available on a free tier with limited functionality
6.2 Payment Terms
- Subscription fees are charged in advance on a recurring basis (monthly or annually as selected)
- All prices are displayed in GBP and include applicable VAT
- Payment is processed securely through our payment provider
- You agree to provide accurate and complete payment information
6.3 Cancellation and Refunds
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial subscription periods unless required by law
- We reserve the right to offer refunds at our discretion in exceptional circumstances
6.4 Price Changes
We may change subscription prices from time to time. Any price changes will be communicated to you at least 30 days before they take effect. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
7. User Roles and Responsibilities
7.1 Students
- Complete quizzes honestly without external assistance unless permitted by your teacher
- Respect the learning environment and other users
- Not share quiz questions or answers outside of the Platform
- Report any technical issues or inappropriate content to teachers or support
7.2 Teachers
- Create appropriate, curriculum-aligned content for students
- Manage classes and quiz sessions responsibly
- Protect student data and use it only for educational purposes
- Not share student results outside authorised channels
- Ensure questions uploaded do not infringe third-party intellectual property rights
7.3 Administrators
- Manage user accounts and class enrolments appropriately
- Ensure compliance with data protection requirements
- Oversee proper use of the Platform within their organisation
- Manage subscription and billing for their organisation where applicable
8. Acceptable Use
You agree NOT to:
- Use the Platform for any unlawful purpose or effects
- Attempt to gain unauthorised access to any part of the Platform
- Interfere with or disrupt the Platform, servers or networks
- Upload malicious code, viruses, or harmful content
- Scrape, copy, or redistribute Platform content without permission
- Impersonate another person or misrepresent your identity
- Use automated tools or bots to access the Platform
- Harass, abuse, or harm other users
- Use the Platform to cheat or facilitate academic dishonesty
- Damage, disable, overload, or impair the Platform's functionality
- Use the Platform in any way that is harmful to minors
- Insert, link or mention any unauthorised advertising
The user will be liable for damages of any kind that Tuition4U may suffer as a result of non-compliance due to misuse of the services and/or improper use of the content.
9. Security Measures
Tuition4U is responsible for implementing appropriate technical, organisational and security measures in relation to personal data, and guarantees the confidentiality, integrity and availability of the information contained therein in accordance with legal provisions.
However, you must be aware that security measures of computer systems on the Internet are not entirely infallible and that, therefore, we cannot guarantee the absolute security of the Internet network and therefore complete protection against the violation of data through fraudulent access by third parties.
10. Intellectual and Industrial Property Rights
10.1 Platform Content
Tuition4U owns or has the corresponding licence to use the intellectual and industrial property rights of the Platform, as well as the content available through it. In no case will access to the Platform be understood to imply a waiver, transmission, licence or assignment, in whole or in part, of said rights by Tuition4U.
It is expressly forbidden to delete, evade or manipulate any data identifying the rights of Tuition4U or owners of other information incorporated into the content, as well as technical protection devices or any information/identification mechanisms.
10.2 User-Generated Content
Teachers retain ownership of questions and quizzes they create. By uploading content, you grant Tuition4U a non-exclusive, worldwide, royalty-free licence to use, store, display and distribute that content for the purpose of operating the Platform.
You represent and warrant that you have the right to share any content you upload and that such content does not infringe the intellectual property rights or other rights of any third party.
11. Quiz Sessions and Results
- Quiz sessions are managed by teachers and may be timed or untimed
- Results are recorded and may be shared with teachers and guardians
- We strive to maintain accurate scoring, but technical issues may occasionally occur
- Teachers have discretion over how results are used for assessment purposes
- Historical results are retained to support learning progression tracking
- We are not responsible for decisions made based on quiz results
12. Links to Other Websites
The Platform may provide access to third-party websites through links in order to inform about other sources of information.
These links to other websites do not suppose in any case a suggestion or recommendation for you to visit the destination web pages, which are beyond our control. Tuition4U is not responsible for the content of linked websites or the results you get by following the links.
If you access an external website from a link found on the Platform, you should read the privacy policy of the other website, which may be different from ours.
13. Limitation of Liability
The information and services included or available through this Platform may include inaccuracies or typographical errors. Periodically, Tuition4U will incorporate improvements, corrections and updates at any time.
Tuition4U does not declare or guarantee that the services or contents will always be available or uninterrupted, that they are free of errors, that defects will be corrected, or that the service or server that makes it available are free of viruses or other harmful components. This is without prejudice to the fact that we make every effort to avoid such incidents.
To the maximum extent permitted by law:
- The Platform is provided "as is" without warranties of any kind
- We do not guarantee specific educational outcomes or examination results
- We are not liable for indirect, incidental, special or consequential damages
- Our total liability is limited to the subscription fees paid by you in the preceding 12 months
- We decline any responsibility for network outages, business losses or indirect damage beyond our control
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
14. Indemnification
You agree to indemnify and hold harmless Tuition4U and its officers, employees, and agents from any claims, damages, losses, liabilities, costs or expenses (including reasonable legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
15. Termination
We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice. You may close your account at any time by contacting us.
Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (such as intellectual property rights, limitation of liability, and indemnification) will remain in effect.
16. Jurisdiction
All the conditions inserted on the Platform are governed by United Kingdom regulations. All conflicts, controversies or situations derived from these conditions will be submitted to the Courts of England and Wales, the parties expressly submitting to their jurisdiction.
17. Changes to These Terms
Please check these Terms of Service regularly. We may update them at any time. We will notify you of material changes by email or through a notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
